Terms & Conditions
This site is owned and operated by Breathe and Live Yoga School represented by Klementyna Kowalczyk, registered in Germany at Am Anger 2A,Odelzhausen, 85235.
These terms and conditions include general terms and conditions for use of this Site, terms and conditions relating to the services provided by Breathe and Live Yoga School on the site and in our studio-classes.
These Terms and Conditions are incorporated into the Registration Form and any Membership is subject to these Terms and Conditions as amended from time to time.
The Breathe and Live Yoga School reserves the right to vary and revoke these Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the internal affairs of the Studios and/or the conduct of Members. Any such changes will be published on the Website and, until revoked, are binding on Members.
Please read these terms and conditions carefully. Your use of the Site, the purchase of any Products or Services on this Site or in a studio will be subject to these terms and conditions. And you now hereby agree to our terms and conditions.
English version of this document is valid for the classes in Polish and German.
Classes are always subject to availability but at Breathe and Live Yoga School we will always do our best to accommodate you in your chosen class.
All classes must be prepaid and all clients agree to our 24hr notice policy when cancelling and/or rescheduling. So if you’re booked into a class, but miss it or cancel with less than 24 hours’ notice, you will be charged for it.
Out of consideration for the trainer and other members, and also for your own safety and warm up, please be aware that if you are more than 5 minutes late for a class, you may not be able to join our practice.
Bookings are made through our website. Classes require two or more people in order to take place.
Our Online Booking Facilities & Rules are as follows:
• Classes can be booked online up to 4 weeks in advance
• All students with online bookings must sign in at least 5 minutes before the class starts.
• When classes have reached their online booking capacity you can add yourself to the waitlist.
• If you are on the waitlist you will automatically be allocated a space in the class once a spot becomes available
• Our booking system will email you a notification.
• You will not be charged the No- Show fee if you are added from a waitlist into the class & you do not cancel.
Members shall be given no less than 30 working days’ written notice of any increase in their Subscription (unless otherwise agreed in their contract). A Member may cancel their Subscription at any time by written request to , giving a 1 month notice before the next renewal date. As stated on the contract.
Members who do not wish to accept a change proposed by the Company to the Terms & Conditions or to pay an increase in any Subscription fees may cancel their Subscription by giving written notice to the School. The notice must be given before or within 30 days after the change to the Terms & Conditions or increase in subscription fees takes effect & must expire at the end of the relevant calendar month. The Member giving notice must continue to pay subscriptions at the current rate immediately prior to any proposed increase until the end of such notice period.
Breathe and Live Yoga School warrants that the Products and Services will be supplied with reasonable skill and care.
Statutory Rights and Refunds and Cancellation
Courses are sold in blocks of 1, 5 or 10 or such other combinations as Breathe and Live Yoga School may introduce from time to time. The Client Shall not transfer sessions to any other person or permit them to be used by anyone other than the Client. Any assignment, transfer or disposal of courses is at the sole discretion of the Trainer and may only be permitted in exceptional circumstances. Class fees are non refundable.
Class fees may be increased by Breathe and Live Yoga School at any time. The Proprietor shall give the Clients not less than 14 days notice prior to any such increases.
Details of class times may vary from time to time. Classes will be published and will be available on our Website.
Any booked sessions must be cancelled within 24 hours, in person or online. In any other case, the session will be charged and deducted from the remainder of the Client’s course.
Early Cancelations– If you cancel more than 24 hours before the start of class no fee is applied. This allows waitlist students to be contacted & join the class.
When you are purchasing a class you are paying for a class and not an instructor. Instructors are subject to change without notice.
The rights of cancellation and refund and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer. Refunds in relation to Products or Services may only be credited to the credit or debit card originally used to make the purchase. An administration fee of 20.00 EUR is applicable.
All Class Packages,, as well as single passes, expire within 1 month of purchase if not used.
The Introductory trial (Restricted and Unrestricted) expires in 30 days and starts from the date the first class is taken.
Special Offer Memberships, such as the Christmas Special start from the date of purchase.
Information displayed on the Site or in our studio as to pricing and availability is subject to change by Breathe and Live Yoga School without notice.
Class size is limited and Breathe and Live Yoga School operates a “first come first served” booking policy. However, for the busy evening classes the Studios offer online reservations for Members who hold current class packs.
A reservation holds a space in a class until 10 minutes before the start of class. All unallocated spaces are returned to “first come first served” spaces for that class.
A Member arriving with less than 10 minutes before the start of class is not guaranteed a space in that class.
Any Member who regularly books online and fails to show up for class without cancelling will be blocked from booking online.
By signing up to our Asana Lab workshops you are opting in for the notifications from our School and join our customers list. All terms and conditions described here apply as if these were a regular yoga classes. If you decide to donate for the Do Yoga Do Good cause, please refer to the Do Yoga Do Good cause terms and conditions.
Do Yoga Do Good
Exactly 50% of the paid amount will be forwarded to the charity selected for the given month. Charities we currently support can be found on our website under Do Yoga Do Good tab.
If the pass is purchased with a discount, the purchase price is the determinant based on which we will calculate 50% of the donation. Example: if you purchased the Do Yoga Do Good pass with 2 EUR discount (purchase price is 8 EUR), only 4 EUR will be donated to the charity of our choice, which is 50% of the purchase price.
If the Do Yoga Do Good pass was given as a reward and there was no purchase price associated with it, there’s no donation linked to it.
Do Yoga Do Good passes purchased in a bundle offer, are counted with the same conditions. 50% of the purchase price is donated to the charity of our choice. In case of the package, the amount is transferred after the cancellation period expires.
We can not provide any invoice on behalf of the beneficent.
Each member of the community can propose a new charity to support, provided it received the 3rd level Karma badge. For the 2nd level Karma badges, the participant can vote to select the charity given month from among the charities proposed by the community, including the members with the 3rd level badges.
Expats in the city partnership
If you were among the first 10 people who booked the Do Yoga Do Good practice with a booking code #EXPATSVOLUNTEER between 24th of February and 31st of March 2021, you will receive a free monthly pass for the online yoga classes to be used within the next week of when it was granted. The booking code is valid for 1 month only.
Example: if you purchased your Do Yoga Do Good pass on 25th of February 2021 and are eligible for a free monthly pass, you will be granted a personalized discount code to be used within 1 week from the moment of receiving it. In this example, your personalized free monthly pass discount code will expire on 8th of February.
You have a liberty to choose which monthly pass to receive and you can choose between 5 or 10 passes. You can still choose the Do Yoga Do Good passes, there won’t be any donation though, as the price of it wasn’t covered.
If you have been given a discount at the check-out of your Do Yoga Do Good pass, i.e. 1 EUR, this will be deducted from your final price of the pass. The donated amount will be still equal to 50% of the purchase price. In this example, it will be 4.50 EUR, instead of 5 EUR. The discount code for the first class for free does not allow you to participate in the poll.

Please bear in mind that you practice yoga online at your own peril. It is advised that you clean up the area around your mat and secure it to make your practice safe. Always consult your doctor before each practice.
Members with low/high blood pressure and/or cardiac irregularities should not attend class until they have written permission from their doctor. If there is any doubt, the Member should consult his doctor. Members must notify the School of any circumstances affecting their health, which may be exacerbated through continued use of the Studio.
Always consult your doctor before signing up for the classes. Please bear in mind that you practice yoga at your own peril. We can’t assist you with the classes led online, therefore the responsibility of securing your space and your health lays on your end. We ask you to listen carefully to the cuing and follow the instructions.
Please report any health issues beforehand and consult with the doctor which exercises will be suitable for you. Use props or skip the exercises that aren’t good for you.
The information available on or through this Site, and the Services supplied via or in connection with this Site or at the Breathe and Live Yoga School do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that such contents and services are suitable for you. It is not our responsibility to do so. Before commencing any exercise regime, you should consult your doctor.
In consideration of Breathe and Live Yoga School accepting a person as a Member, the Member agrees that:
Breathe and Live Yoga School, nor its partners, instructors and employees are responsible for any injuries suffered by the member caused whole or in part by the Member’s failure to faithfully follow the instructions of the instructor or by any physical impairment of mine not fully disclosed to the Studios in writing.
It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this web site (and provided by us to you as part of any Services or Products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this web site or provided through any Service supplied by us to you.
Neither Breathe and Live Yoga School, nor its partners, instructors and employees are responsible for loss or damage to a Member’s personal belongings.
Breathe and Live Yoga School reserves the right to change the class schedule, including cancellation of individual classes and change of instructor without notice.
You, your legal representatives and your heirs release waive, discharge and covenant, not to sue Breathe and Live Yoga School and its instructors for any injury or death caused by their negligence or other acts.
Personal belongings & Safety
For security reasons Members are advised to place all their valuables in a safe place including using the shelves in the studios. Members are requested to wear clothing that preserves their dignity throughout the full range of movement and we will not accept any claims in regards to this.
Breathe and Live Yoga School is a shoe free zone. All outdoor footwear is to be removed as soon as possible and not worn in the practice room. For safety reasons and because all Members are barefoot – No crockery, glass or anything breakable is permitted in any part of the Studios. Members should not walk around the Studios barefoot if they have verucas or similar foot complaints.
No food is to be consumed within the yoga studio. Members are advised to use a suitable towel for the purpose of covering their yoga mat in the studio and are required to clean their yoga mat before and after each practice with the means provided by the school.
In the event of a fire, Members are asked to make their way to the nearest available exit.
Site usage and Intellectual Property Rights
You may use the Site for personal and lawful use and in accordance with these terms and you are not allowed to copy or use any material from the Site for any commercial purpose.
The intellectual property rights in all contents of the Site and supplied as part of the Products or Services, and in the Breathe and Live Yoga School trade marks and logos (“Materials”) are owned by Breathe and Live Yoga School. Except to the extent expressly set out in these terms and conditions, you are not allowed to make any copies of any part of any Materials, or remove or change anything on the Site, include or create links to or from the Site without our written authority, or remove or change any copyright, trade mark or other intellectual property right notices contained in any Materials or copies thereof.
You must not use the Site to post, upload or otherwise transmit material which is obscene or pornographic, threatening, menacing, racist, offensive, defamatory, infringing of any intellectual property or otherwise unlawful, to harass, stalk, threaten or otherwise violate the rights of others, to misrepresent your identity or status, to hack into this Site or any other related computer system, to make excessive traffic demands, deliver viruses or forward chain letters or similar materials that may reasonably be expected to inhibit other users from using and enjoying the Site or any other web site or damage or destroy the reputation of Breathe and Live Yoga School.
Breathe and Live Yoga School accepts no obligation to monitor the use of the Site. However, Breathe and Live Yoga School reserves the right to disclose any information as required by law and/or to remove, refuse to post or to edit any information or materials, to block your access and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions or any breach of applicable law or regulation. Breathe and Live Yoga School will also in its absolute discretion fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security.

Code of Conduct
Students shall adhere to Breathe and Live Yoga School’s code of conduct at all times:
– Come to the yoga class clean
– The use of (unscented) deodorant is highly appreciated. Because of some Student’s sensitivities or allergies, please refrain from wearing any perfume, aromatherapy or other scents.
– Wear clean, comfortable clothing during the yoga class.
– It is advised not to eat later than 2 hours prior to a yoga class. In any case, do not practice yoga on a full stomach.
– No shoes in the yoga studio, and no glass in the rooms.
– Phones should be turned off/put on flight mode during the classes
– Breathe and Live Yoga School can but doesn't have to provide yoga mats for use during the yoga classes.
– The (physical) integrity of the Students shall be respected at all times.
– Arrive at least 10 minutes early. If the student arrives late (over 5 minutes) it will not be allowed to enter the classes.
- Respect the environment and each others and treat others as you would like to be treated. We won't accept any hate or misconduct.
The Student must be able to support the group yoga practice. The Student may be requested to leave the practice, if it is determined by the Teachers that his/her participation would in any way compromise a safe and cohesive learning environment or are in conflict with the Yoga Alliance Ethical guidelines:
Breathe and Live Yoga School reserves the right, at its discretion, to deny Students entry to Breathe and Live Yoga School and terminate their participation in the practice, as the case may be, who do not adhere to the code of conduct or do otherwise disturb the peace, without reimbursing any already paid Tuition.
Your personal information
Breathe and Live Yoga School, along with the yoga teachers are not carrying any responsibility due to the health or personal damage during the online classes. Breathe and Live Yoga School shall not be liable for any injury, loss or damages in connection with, or resulting from, participation in the practice or any activity ran by the Breathe and Live Yoga School.
Breathe and Live Yoga School may change these terms and conditions from time to time. By browsing the Site you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the Site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.
These terms and conditions shall be governed and interpreted in accordance with German law, and you consent to the non-exclusive jurisdiction of the German courts.
